As there was affidavit filed by the present petitioner viz. Shashadhar Mondal and the same has not been till date materialised, I direct the learned trial court to proceed with the trial of the case in accordance with law. The said affidavit may be brought in evidence and the petitioner may be allowed to rebut the same in course of the trial of the case. In view of the case having commenced in the year 2022, the learned trial court would fix regular dates so that trial of the case can be taken to its logical conclusion within a reasonable period of time.

With the aforesaid observations, the revisional application being CRR 3852 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
