The petitioner participated in the selection process for being appointed in the post of 'Peon' in the unreserved category in the year 2007. The petitioner has averred in the writ petition that he believes that he stood first in the panel which was prepared by the Selection Committee. As the case of the petitioner was not taken up for consideration for issuance of letter of appointment even though he was the first empanelled candidate he approached this Court by filing the instant writ petition.

By an order dated 10th October, 2012 this Court directed that no appointment be made in the post of 'Peon' without considering the case of the petitioner on the basis of his position in the panel which was prepared in the year 2007 without obtaining leave of this Court until further order. The interim order is pending till date. As considerable period of time has elapsed in the meantime, this Court thinks it fit to direct the Director of

Public Instruction to take a decision with regard to the filling up the post in question by considering the case of the petitioner on the basis of his position in the merit panel. In the event, it appears that the petitioner possesses the requisite eligibility criteria for being appointed in terms of the advertisement in question, then the concerned authority shall take further necessary steps to conclude the selection process.

The Director of Public Instruction shall take necessary steps in the matter at the earliest, but positively within a period of eight weeks from the date of communication of a copy of this order.

The writ petition stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
