Petitioner complains that he was victimized has he has complained against developer/promoter with the K.M.C. authorities, pursuant to which demolition order was passed and subsequent to which the said person used his female relations for instituting case against the present petitioner. According to the petitioner there are three cases, one being Taltala PS Case No 51/2014, another being Taltala PS Case No. 121/2022.

Petitioner complains that another case was registered at Shakespeare Sarani Police Station.

According to the petitioner in all the case evidence has commenced. Petitioner complains that since 2014 he has been suffering for the last 10 years and the ladies are not available to depose before the court after the recall application was allowed by the learned trial court.

Be that as it may, the trial court is already in seisin of the matter. Petitioner is knocking the doors of the court for more than 10 years.

Having considered that a criminal case should not degenerate into a weapon of harassment, I direct the learned trial courts to conclude the trial as expeditiously as possible without granting further adjournment particularly, in respect of the two cases which were initiated in the year 2014.

Learned advocate for the state is present. He is directed to communicate to his counter-part regarding order passed by this court.

Petitioner will also be at liberty to adduce his own evidence, so far as the steps taken by the petitioner before the Kolkata Municipal Corporation is concerned and as a counterblast of which allegedly the present cases have been instituted at the D.W. stage after the procedure under section 313 Cr.P.C. is concluded.

With the aforesaid observations WPA 24469 of 2024 is disposed of.
