Learned advocate appearing for the petitioner submits that the petitioner is in custody for 122 days and charge-sheet has already been submitted, as such the petitioner may be released on any stringent condition.

Learned advocate appearing for the State has opposed the prayer for bail, drawing the attention of the Court to the statement of the victim under Section 164 of the Code of Criminal Procedure as well as the other documents. In view of the stage of the case, I direct the learned Magistrate in seisin of the issue to complete the process of supply of documents within a period of 15 days from the next date so fixed. The case be thereafter committed to the Court of Sessions. Learned Sessions Judge or any Court to whom the learned Sessions Judge delegates would conclude the process

on consideration of charges preferably within a period of 45 days from the date of receipt of the records. Petitioner would be at liberty to approach this Court after the stage of consideration of charges is over. At this stage CRM (M) 1866 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
