1. The report dated 18.01.2024 as filed on behalf of the State is taken on record.

2. On perusal of the report dated 18.01.2024, it reveals that the Superintendent, Jalpaiguri Central Correctional Home has communicated that the convict, Bhajan Sarkar who is the appellant before us was released from Jalpaiguri Central Correctional Home after suffering his sentence on 04.01.2024.

3. At this stage, learned Counsel for the appellant submits before this Court that on account of ill-health of the present appellant and also on account of his financial stringency, the present appellant is not willing to proceed with the instant appeal and accordingly, the instant appeal may be disposed of as withdrawn at the instance of the appellant.

4. In view of such submission as made on behalf of the appellant, the instant appeal being CRA 593 of 2010 stands hereby withdrawn at the instance of the appellant.

5. In view of the observation made hereinabove, the instant appeal being CRA 593 of 2010 is disposed of.

6. Department is directed to send down the LCR at the earliest along with a copy of this order.
