In view of the innocuous nature of the prayer made, prior service of notice on the Opposite Parties is not being directed.

The present application under Article 227 of the Constitution of India arises out of the eviction suit filed in the year 2015.

It is submitted by learned Counsel for the plaintiffs/petitioners that the suit is now awaiting filing of the report by the Commissioner appointed by the court and the peremptory hearing is yet to begin. It is further submitted that there is no other pending application in the suit.

Accordingly, in view of the inordinate delay in disposal of the suit, CO 3489 of 2024 is disposed of by requesting the learned Civil Judge, (Junior Division), 1st Court at Alipore, District - South 24 Parganas to dispose of Ejectment Suit No. 16 of 2015

pending before the said court as expeditiously as possible, positively within March 31, 2026. In order to implement the order, the learned Trial Judge will be at liberty to pass necessary directions on the Commissioner to file his report expeditiously. 5.

There will be no order as to costs.

The parties and all concerned shall act on the server copy of this order without insisting upon prior production of any certified copy for the purpose of compliance.
