It is submitted on behalf of the petitioners that the State respondents issued notice under Section 3 of the West Bengal Land (Requisition and Acquisition) Act, 1948 for requisition of the land of the petitioners for construction of pump house and rest house under Water Supply Scheme at Joynagar area. The land has been admittedly utilised, but no compensation has been paid to the petitioners for the same. The petitioners submitted a representation before the concerned authority requesting payment of compensation pursuant to which the petitioners were directed to appear before the authority by a notice issued by the Special Land Acquisition Officer, Bankura.
The petitioners appeared before the authority on the relevant date and hearing was concluded. But no order has been communicated to the petitioners till date. The
petitioners pray for a direction upon the concerned authority to communicate the order to the petitioners and take necessary steps for disbursement of the compensation in their favour according to the present market value of the property in question.
Learned counsel for the respondents submits that the 4th respondent be directed to comply with the order passed by this Court.
In view of the above, the writ petition is disposed of directing the 4th respondent to communicate the order passed by him in connection with the application made by the petitioners within four weeks from the date of communication of this order.
In the event the petitioners are found entitled to compensation, such compensation be disbursed in favour of the petitioners within two months thereafter. There shall be no order as to costs.
Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
