Rakib CRM (M) 1874 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Basudebpur Police Station Case No. 95 of 2025 dated 20.03.2025 under Sections 8/12 of the POCSO Act, 2012.

And In the matter of : Subham Shaw ......Petitioner.

Mr. Debasis Kar Mr. Husen Mustafi ......for the Petitioner.

Ms. Zareen Nasema Khan Mr. Ashoke Das ......for the State.

Petitioner was granted interim bail during the vacations and thereafter the bail order was extended till 21st of November, 2025.

However, in none of the orders I find that Case Diary was made available.

Having considered that the Case Diary was not a subject matter of consideration of this Court at the time of granting interim bail, the interim bail is extended till 28th of November, 2025.

Petitioner is directed to appear before the learned trial Court on 25th of November, 2025.

State would produce the Case Diary before the learned trial Court.

Learned trail Court will freshly consider the bail application after hearing the petitioner, de-facto complainant as well as the State.

With the aforesaid directions CRM (M) 1874 of 2025 is disposed of.

In case the accused do not appear before the learned trial Court, learned trial Court would exhaust the process of law and will not deter to take any harsh steps. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
