Ghosh Mr. Tanmoy Chowdhury ... for the petitioner Judgement and order of learned Additional District Judge, 2nd Court, Suri, Birbhum passed on 24.10.2005 in Criminal Appeal No. 10 of 2004 affirming thereby the judgement and order of conviction passed by learned Judicial Magistrate, Dubrajpur, Birbhum in G.R. Case No. 683 of 2001 convicting the petitioner for committing offence under Section 498A of Indian Penal Code is the subject matter of challenge in this application for revision. Mr. Chowdhury, learned counsel representing the petitioner submits that from his end an attempt was made to intimate the petitioner about the proceeding and the registered envelope has come back with an endorsement "deceased". Mr. Chowdhury, further submits that the petitioner was the sole convict. With the death of the petitioner thereby the entire proceeding gets abated.

Under such circumstances, the petition under consideration has become devoid of merit and is disposed of with the aforesaid observation.
