The petitioner claims that he was on duty as a first training attendant in connection with the Panchayat General Elections. To that effect, certain documents have been enclosed along with the revisional application wherein it reflects after the polling he was released on 08.07.2023 at about 11.50 p.m. Mr. Jana, learned Advocate, appearing for the petitioner who has challenged the continuance of Harischandrapur Police Station Case No. 669 of 2023 dated 09.07.2023 submitted that the present case was initiated pursuant to a complaint in respect of the alleged offence which occurred on 08.07.2023 at about 10.30 p.m. According to the learned Advocate, appearing for the petitioner at the relevant point of time on the basis of the documents so submitted, which are of sterling quality, petitioner was at a place which is about 40 kilometers from the place of occurrence.

Having considered the documents which have been enclosed along with the revisional application, I direct the petitioner to hand over and place the documents before the investigating officer of the case. The investigating officer would take the aforesaid documents into consideration and place his

comments regarding the genuinity and authenticity of the same and thereafter file his report under Section 173 of the Code of Criminal Procedure.

With the aforesaid observations, CRR No. 3855 of 2023 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this court.
