The present revisional application was preferred challenging the proceedings of Case No. C-5375 of 2001 under Sections 488A/406/324/120B of the Indian Penal Code which at the relevant point of time was pending before the learned Metropolitan Magistrate, 5th Court, Calcutta.

Record of this revisional application reflects that although initially there was an interim order of stay in respect of the proceedings but the said interim order was never extended beyond 3rd September, 2008, more than 13 years have passed and this court has not been apprised regarding the present stage of the proceedings pending before the learned Metropolitan Magistrate, 5th Court, Calcutta. Having regard to the same, I direct that in case the proceedings are still pending, the learned Magistrate would grant an opportunity to the petitioners to agitate the points canvassed in the revisional application at the appropriate stage of the proceedings.

With the aforesaid observations, the revisional application being CRR 3557 of 2005 is disposed of.

Pending applications, if any, are consequently disposed of.
