For the Kolkata Port Trust The grievance of the petitioners is directed against police inaction. The writ petition was filed as far back as in 2008. It is fairly submitted on behalf of the petitioners that with the passage of time, the writ petition has become purely academic. The petitioners relies on an order dated 12th March, 2008.

The respondent Kolkata Port Trust is represented and submits that the persons in possession of the premises have voluntarily given up their possession and no effective order can be passed in this present writ petition.

In view of the long passage of time and the fact that the cause of the petitioners has presently become stale, I am of the view that no useful purpose would be served in keeping the petition alive.

24079 of is dismissed as infructuous.

There will be no order as to costs.
