Affidavit-of-service filed in court today be kept on record.

Learned counsel for the petitioner contends that the petitioner, with due permission from the true owner, is seeking to organize a Durga Puja this year on the land of the said owner.

Although under normal circumstances, permission is not necessary as such the petitioner, for abundant caution, has sought such permission from the authorities to avoid any unnecessary complications at the time of holding the Puja.

It is further contended by learned counsel for the petitioner that although the petitioner has been holding Durga Puja on previous occasions, no permission as such was taken previously.

Learned counsel for the State hands over a copy of a communication by the Inspector-in-Charge of the Egra

Police Station indicating that the Police Station has no objection to celebration of the Durga Puja.

However, it is stated that there has been no online application on the part of the petitioner.

Be that as it may, since the petitioner seeks permission, the mere technical requirement of an online application need not be pressed too hard.

Accordingly, WPA 23625 of 2023 is disposed of by directing the respondent no. 4, the Sub-Divisional Officer, Egra Sub-Division to consider the petitioner's application for holding a Durga Puja as per the petitioner's request, annexed to the writ petition, within October 16, 2023 and immediately thereafter to communicate the outcome of such decision to the petitioner.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
