Ali ....for the OP Though this matter is appearing in the list under the heading 'Extension of Interim Order' but with the consent of the learned advocates for the respective parties the civil revision application is taken up for final hearing. By the order impugned dated August 13, 2024 passed by the learned Judge 10th Bench, City Civil Court at Calcutta in Title Suit No.600 of 2018, the plaintiff was allowed to effect the repairs at his own cost within the time indicated in the said order and upon failure on the part of the plaintiff to effect such repair the defendant was given liberty to do the same at his own cost.

It has been uniformly submitted by the learned advocates for the respective parties that the repairs have been effected by the defendant at his own cost. In view thereof nothing survives to be decided in this civil revision application.

Accordingly CO 3490 of 2024 along with CAN 1/2024 stands disposed of.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
