The petitioner joined the service as a cleaning staff with Central Industrial Security Force (CISF) on November 6, 1996. The petitioner was dismissed from service with immediate effect by a final order dated June 11, 2020 passed by the Disciplinary Authority. The petitioner preferred an appeal. Mr. Mondal, learned counsel appearing on behalf of the petitioner submits that the appeal was rejected since the petitioner did not prefer the same within the stipulated time, by an order dated September 21, 2020.

The petitioner through his advocate made a representation on August 23, 2023 for payment of his admissible dues.

Mr. Ghosh, learned counsel appearing on behalf of Union of India submits that all the admissible dues

of the petitioner have been paid. Nothing further requires to be paid to the petitioner.

Considering the rival submissions of the parties and the materials placed on record, this Court is of the view that justice will be sub-served by directing the Commandant, CISF, District - Paschim Bardhaman/respondent no.5 or any other authority delegated by him to consider the representation of the petitioner dated August 23, 2023 and pass a reasoned order within 8 weeks from date. The reasoned order shall be communicated to the petitioner within 2 weeks of passing thereof.

With the directions aforesaid, WPA 23628 of 2023 is disposed of.

Since no affidavits have been directed to be exchanged in the writ petition, the allegations contained therein are deemed not to have been admitted by the respondents.

All parties shall act on the server copies of this order duly downloaded from the official website of this Hon'ble Court.
