The learned Counsel for the parties have jointly submitted that during the pendency of the appeal, the dispute between the parties has been amicably settled.

The learned Counsel for the appellants has placed before us the original letter of instruction dated 9th July, 2025 wherefrom it appears that the appellants in view of the settlement arrived at between the parties are unwilling to proceed with the appeal. 3.

In view thereof, the appeal and the connected application are dismissed for non-prosecution. 4.

The original letter of instruction dated 9th July, 2025 is kept with the record.

The department is directed to send down the T.C.R. to the learned Trial Court.
