Mr. Karmakar, learned advocate appearing for the petitioner submits that the application filed by the award holder for withdrawal of the execution case is pending for long.

Record reveals that by an order dated 3rd August, 2023, the learned Civil Judge, Senior Division (2nd Court) at Barasat fixed on 2nd December, 2023 for passing orders. 3.

Mr. Karmakar, learned advocate submits that no order was passed on 2nd December, 2023 and the date has been fixed for passing orders on 31st January, 2024. 4.

Accordingly, the application being, C.O. 3514 of 2023 is disposed of by requesting the learned Civil Judge, Senior Division (2nd Court) at Barasat to take up the hearing of the application for withdrawal of the execution case on the next date fixed i.e. on January 31, 2014 and to dispose of the same on January 31, 2024. In

the event, the same cannot be disposed of on that date, the learned Civil Judge is requested to dispose of the same immediately thereafter.

There shall be, however, no order as to costs. 6.

Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
