In view of the innocuous nature of the order proposed, prior service of notice is not directed. 2.

The plaintiff in a suit under Section 6 of the Specific Relief Act, 1963 has preferred the present application seeking early hearing of the pending injunction application in the suit.

Learned counsel for the petitioner also seeks a direction for early disposal of the suit itself. 4.

Keeping in view the long pendency of the matter since the year 2021 and the implicit urgency involved in a proceeding under Section 6 of the Specific Relief Act, this court is of the opinion that the purpose of justice would be sub-served if the pending application and the suit are directed to be disposed of expeditiously.

Accordingly, C.O. 3493 of 2024 is disposed of by requesting the learned Civil Judge, Junior Division, First Court at Barasat, District-North 24 Parganas to dispose of the pending injunction application in

connection with Title Suit No.325 of 2021 before it as expeditiously as possible, positively within four weeks from the date of communication of this order to the learned Trial Judge.

Thereafter, the learned Trial Judge shall dispose of the suit itself within six months from the date of disposal of the injunction application.

The parties and all concerned shall act on the server copy of this order without insisting upon prior production of a certified copy for the purpose of compliance.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
