Mr. Masud Karim Mr. Satyam Pandey ..for the Petitioner Mr. Suman Sengupta ... for the State Challenging the maintainability of the writ petition, learned counsel for the State submits that the dispute between the private parties is civil in nature and the writ petition is not maintainable.

Learned counsel for the petitioner submits that in a civil suit filed by one Dulal Bhunya against the petitioner and the private respondents in respect of the plot in question, the learned Trial Court granted an order of injunction directing both the parties to maintain status quo in respect of the nature, character and possession of the property till disposal of the suit. The petitioner alleges that despite such order, the private respondents are raising construction in the property in violation of the order. The petitioner seeks police assistance to stop such construction.

Since the learned Trial Court has granted order of status quo in respect of nature, character and possession of the property in the title suit which is subjudice, the

petitioner is at liberty to approach the learned Trial Court for redressal of his grievance.

With the above observations and directions this writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
