The petitioner's mother was the original applicant before the Authority under the Payment of Gratuity Act, 1972. She was engaged by the Calcutta Jute Manufacturing Co. Limited. After the death of the petitioner's mother, the writ petitioner was substituted as the applicant.

The proceedings have been long pending before the Controlling Authority, without disposal.

In that view of the matter, this Court directs the respondent no. 2 to dispose of the petitioner's application being Case No. G-54/12 within a period of five months from the date of communication of a copy of this order. These directions are peremptory. 4.

It is submitted by the learned counsel for the petitioner that the original records of the proceedings before the Authority may have been lost.

Appropriate measures may be taken up for reconstruction of the file in accordance with law by the Authority in this regard.

The writ petition is disposed of.

7.

There will be no order as to costs.

8.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
