09.11.2022 sdas rejected C.R.M.(DB) No. 3898 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Kalyani Police Station Case No. 26 of 2018 dated 26.01.2018 under Sections 302/201/34 of the Indian Penal Code.

And In Re : Rohit Mitra ..... petitioner Mr. Shibaji Kumar Das Ms. Rupsa Sreemani ... for the petitioner Ms. Zareen N. Khan Mr. Asoke Das ... for the State Petitioner renews his prayer for bail.

Learned Counsel appearing for the petitioner submits there is slow progress in the matter since last rejection of bail. Learned Counsel appearing for the State opposes the prayer for bail and submits seven out of fourteen witnesses have not yet been examined.

We have considered materials on record. Petitioner was last seen with the victim prior to his death. There is also evidence of inimical relationship between the parties. Trial has substantially progressed.

Under such circumstances, we are not inclined to grant bail to the petitioner at this stage.

The application for bail is, thus, rejected.

Trial court is requested to expedite the trial and conclude the same at an early date without granting any unnecessary adjournment to either of the parties. (Ajay Kumar Gupta, J.) (Joymalya Bagchi, J.)
