Mr. Karmakar, learned advocate for the petitioner submits that this application under Article 227 of the Constitution of India should be presented before the Bench having criminal determination. He prays for leave to withdraw this civil revisional application with liberty to file afresh before the appropriate forum. Such prayer is allowed.

Accordingly, C.O. 3519 of 2023 is dismissed as withdrawn with liberty to the petitioner to file afresh challenging the order impugned before the appropriate forum in accordance with law.

Petitioner will be at liberty to take back the certified copy of the order impugned upon replacing the same by a photocopy thereof.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
