Petitioner is in custody for 783 days. There is inordinate delay in trial. On such score co-accused have been granted bail. He prays for bail.

Learned lawyer for the State opposes the bail prayer. He submits defence contributed to the delay.

We have considered the materials on record. On the score of delay in trial co-accused Mahesh Fogla, Gautam Banerjee and Sourav Agarwal have been enlarged on bail. Petitioner is also entitled to similar relief.

Accordingly, the petitioner be released on bail upon furnishing a bond of Rs. 10,000/- with two sureties of like amount each, one of whom must be local to the satisfaction of the learned CJM Calcutta on condition that the petitioner shall appear before the trial court on every date of hearing and shall not intimidate witnesses or tamper with evidence in any manner whatsoever. 5.

In the event he fails to appear before the trial court without justifiable cause, the trial court shall be at liberty to cancel his bail automatically without reference to this court. Signed By :
