This is an application for expeditious hearing of Title Suit No.230 of 2004 pending before the learned Civil Judge (Senior Division), 1st Court at Hooghly.

Record reveals that on 27th March, 2020 was fixed for further cross-examination of D.W.1, as a last chance. It further appears from the records that petitions under Order 22 Rule 3 of the Code of Civil Procedure dated 20th February, 2021 and under Order 22 Rule 4 of the Code of Civil Procedure dated 22nd December, 2021 were disposed of on 7th August, 2023 and 21st August, 2023 was fixed for filing of amended plaint and steps upon the substituted defendants.

On a query of this Court, the learned advocate for the petitioner submits that pursuant to the order No.60 dated 7th August, 2023, the amended plaint has already been filed and steps upon the substituted defendants have

been taken, as directed by the order dated 7th August, 2023.

In the light of the aforesaid submissions of the learned advocate for the petitioner, C.O. 3522 of 2023 is disposed of by requesting the learned Civil Judge (Senior Division), 1st Court at Hooghly to dispose of the Title Suit No.230 of 2004 as expeditiously as possible without granting any unnecessary adjournments to either of the parties, if the same is otherwise ready for hearing. 5.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
