Written instruction as handed over in Court today by Mr. Chatterjee, learned counsel appearing on behalf of the respondents is retained with the records.

The petitioners are working as Senior Laboratory Technicians with the National Institute of Biomedical Genomics (NIBMG), an autonomous body under the Government of India. The petitioners' grade pay was enhanced from Rs.4,200/- to Rs.4,600/- by an office order dated February 26, 2014. The said grade pay was to be effected from their respective dates of joining in 2010. By a communication dated May 8, 2023, the Under Secretary to the Government of India informed the Director, NIBMG that the grade pay of the petitioners was to be given with retrospective effect subject to fulfilment of all other conditions.

In view of the submissions made by the parties, this Court directs the arrears of grade pay to be paid to the petitioners within 3 months from date. All other consequential benefits will also be given to the petitioners inter alia in terms of the Modified Assured Career Progression (MACP) Scheme. The arrears of such benefits under the said scheme will also be paid to the petitioners within 3 months from date, subject to compliance of necessary formalities, if any. With the directions aforesaid, WPA 23910 of 2022 is disposed of.

Since no affidavits have been directed to be exchanged in the writ petition, the allegations contained therein are deemed not to have been admitted by the respondents.

All parties shall act on the server copies of this order duly downloaded from the official Website of this Hon'ble Court.
