Learned advocate appearing for the petitioner(s) submits that the petitioner(s) is in custody for three years and four months and the evidence of the case has not been concluded, while it was stated by the prosecution on the last occasion that
the trial would be completed. According to the petitioner(s) he is innocent of the charges and has been falsely implicated in the instant case.
On the other hand learned Public Prosecutor submits that the petitioner(s) along with others fired at the victim. The petitioner(s) has antecedents. It has also been pointed out that examination-in-chief of PW13 i.e. investigating officer of the case is in progress. The investigating officer is the last witness proposed to be examined by the prosecution. The next date has been fixed before the learned trial Court on 20th December, 2025.
Having considered that the prosecution evidence is at the fag-end and the evidence of the investigating officer is in progress, I am not inclined to release the petitioner(s) on bail at this stage.
Accordingly, the prayer for bail of the petitioner (s) in CRM (M) 1898 of 2025 and in CRM (M) 1903 of 2025 is dismissed.
On consent of both the parties, let CRM (M) 1903 of 2025 be treated as on day's list.
Report submitted by the State be kept with the record. Steps be taken to conclude the examination-in-chief of the investigating officer by 31st of December, 2025.
In case, the Court is not available, the Court in-charge would continue with the evidence of the investigating officer of the case.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
