Mr. Swaarup Paul Mr. Surya Maity Mr. Gurusaday Dutta ..... for the petitioners Mr. Samrat Sen Mr. Amrita Lal Chatterjee ......for the State The grievance of the petitioner is that despite a communication by the Director, ESI dated 17th August, 2022 by which the petitioner was permitted to participate in the financial bid along with the other bidders for the tender floated by ESI, a representation made by the petitioner on 5th September, 2022 to the Hospital has not been considered and disposed of till date.

Learned A.A.A.G. is present.

WPA 23915 of 2022 is disposed of with the direction on the respondent No. 4 to dispose of the representation within two weeks from date. The ESI Hospital shall be at liberty of hearing the petitioner and the existing contractors before passing a reasoned order. A copy of the reasoned order shall be furnished to the petitioner within one week from which the order is passed.
