And In the matter of: Shankar Mondal ....Applicant/Petitioner Mr. Sumanta Das ...for the petitioner Ms. Baisali Basu Ms. Trisha Rakshit ..for the State Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is sixty five years old. He has been falsely implicated in this case. It was the local people who had assaulted the alleged victim.

Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. She refers to the statements of the local witnesses as also to the injury report. She submits that injuries were inflicted on vital parts of the body including head. Two fingers of the victim got fractured.

Considering the incriminating materials available in the case diary, I do not consider that this is to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail of the petitioner is rejected.
