None appears for the private respondents despite service.

Heard learned counsels for the parties.

The petitioners are the unfortunate parents of the private respondent who resides in their house and continues to torture and assault them.

The petitioners lodged complaint before the police authority which was not considered.

It appears from the report submitted by the State that upon holding enquiry pursuant to the complaint lodged by the petitioner prosecution under Section 126 of the BNSS has been submitted.

Since the house in question allegedly belongs to the petitioners, the private respondent can at best be termed as licensee under them and they are at liberty to seek his eviction from the house before the appropriate forum.

In the meantime, the police authority shall keep strict vigil over the area and ensure that the peace and tranquility is maintained. The police authority shall render necessary assistance/protection to the petitioners as and when sought so that they are able to stay in their own house without any obstruction whatsoever and without suffering any torture or assault.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
