Learned advocate appearing for the petitioner submits that the petitioner is in custody for 2 years and 1 month and the prosecution till date has examined only 1 witness partly. From the charge sheet it reflects prosecution intends to rely upon 12 witnesses to prove its case. On any stringent condition petitioner prays for bail.

On the other hand, learned advocate for the State opposes the prayer for bail, draws the attention of the Court to the post-mortem report along with the statement of the child witness as well as the mother of the deceased wife. I have taken into account the materials available in the case diary and I am of the view that the prosecution would

complete the first 5 witnesses mentioned in the charge sheet by 31.03.2026.

Accordingly, the prayer for bail in CRM (M) 1907 of 2025 is dismissed at this stage.

Petitioner will renew his prayer for bail after the aforesaid time period is over.

No unnecessary adjournment be granted to any of the parties. The trial of the case would continue in spite of any resolution by the local bar.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
