Heard learned Counsel appearing for the parties and perused the materials available in the case diary. 2.

Having heard the Learned Counsel for the petitioner and also taking into consideration the objection of the State Counsel, I find that the presence of the present petitioner has been confirmed by all the witnesses who have deposed before the learned Trial Court. It is also found from the materials in the case diary that one pipe gun was seized from the petitioner and from the ballistic report it appears that the bullet, which was recovered from the body of the victim, was shot from the said pipe gun of the present petitioner.

In view of the above, I am not inclined to grant bail to the petitioner.

The prayer for bail stands rejected.
