Petitioner submits that the land in question was described in the land records as 'private devottar estate'. He purchased the property through a valid instrument. Allegation of absence of title is out and out false.

Learned lawyer for the State oppose the prayer for anticipatory bail.

We have considered the materials on record. Subject matter of dispute essentially relates to title in immovable property. Investigation revolves around documents which are available in the official records. Petitioner expresses his desire to co-operate with investigation.

Under such circumstances, we are of the opinion custodial interrogation of the petitioner is not necessary but he requires to co-operate with investigating agency in accordance with law. 5.

Accordingly, we direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs. 10,000/- with two sureties of like amount each, to the satisfaction of the Arresting Officer and also be subject to the conditions as

laid down under section 438(2) of the Code of Criminal Procedure, 1973 and on further condition that the petitioner shall meet the investigating officer once in a week until further orders. 6.

Petitioner shall appear before the court below and pray for regular bail within four weeks from date.
