Learned advocate appearing for the petitioner submits that the petitioner was arrested for having in his conscious possession 65 bottles of codeine mixture. Petitioner is in custody for 9 months 20 days and charge-sheet has already been submitted. As such, petitioner prays for bail on any stringent condition.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that petitioner is a history-sheeter with 13 cases pending against him. Rebutting such contention of the State, learned advocate for the petitioner submits that petitioner is on bail in all the cases, he has been acquitted in number of cases and he was arrested because of his previous enmity with the police authorities.

Having regard to the period of detention of the present petitioner, I am of the view that further detention of the petitioner is unwarranted. As such, the prayer for bail of the petitioner is allowed.

Accordingly, the petitioner viz., Saiyad Sahjada @ Saiyad Jafar Hossain shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Special Judge (NDPS Act), Barrackpore.

If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Special Court and shall not enter the jurisdiction of Barrackpore Police Commissionerate except for the limited purpose of attending the Court.

Report submitted by the learned advocate appearing for the State be kept with the record.

The application for bail, being CRM (NDPS) 1224 of 2025, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
