Learned advocate appearing for the petitioner submits that the petitioner is in custody for about 2 years and he has been implicated in connection with the instant case for alleged recovery of 7500 bottles of phensedyl. Learned advocate submits that there is no possibility of the trial concluding in near future as only 3 witnesses have been examined and the prosecution intends to examine 17 witnesses in support of its case.

Learned advocate for the State opposes the prayer for bail by drawing the attention of the Court to the materials which have been collected in course of investigation. It is stated that the evidence of the P.W.4 is in progress and prosecution intends to examine 12 more witnesses in support of its case.

I have considered the charge-sheet wherein C.S.5 to C.S.11 has been cited as seizure list witnesses. Prosecution is directed to conclude these witnesses within a period of four months from the next date before the learned trial court.

At this stage, the prayer for bail of the petitioner in CRM(NDPS)1238 of 2025 is dismissed.

Petitioner will renew his prayer for bail after the evidence of the seizure list witnesses are over.

The investigating officer of the case is present in Court today. His further appearance before this Court is dispensed with. Report submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
