Ms. Sucharita Paul, learned advocate appearing on behalf of the Insurance Company submits on instruction that the claimant has already taken away the award through the execution process before the learned Tribunal. So, at this juncture, further proceeding of the instant appeal would be infrustuous. She placed written instruction from the concerned company. Perused the written instruction, let the written instruction be kept on record. It is ordered that the instant appeal is dismissed as not pressed.

The Insurance Company is at liberty to return back the statutory deposit of Rs.25,000/- with the office of the learned Registrar General, High Court, Calcutta along with accrued interest if any.
