The records of the case reflect that the charge-sheet was submitted before the learned trial court on or about April, 2023. The petitioner has enclosed the FIR and the Chargesheet and none of the documents under Section 207 Cr.P.C. has been enclosed with the revisional application. Learned advocate appearing for the petitioner submits that there was a relationship between the de facto complainant and the petitioner. The same is a question of fact. It is to be gone into in course of the trial.

Be that as it may, the petitioner would be at liberty to take out an application under Section 239 of the Cr.P.C., if so advised before the jurisdictional trial court. The learned trial court will consider the same in accordance with law and without being influenced by any observation of this Court. With the above observations, CRR 3881 of 2023 is disposed of.
