Kausik (Rejected) CRM (NDPS) 1230 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Ilambazar PS Case No. 54 of 2025 dated 07.02.2025 under sections 20(b)(ii)(c) of the NDPS Act.

Learned advocate appearing for the petitioner submits that he has been falsely implicated as a counterblast to the resistance offered by him.

Learned advocate submits that the false implication in this case is because of the excess action of the police authorities particularly with regard to the issues for which the present petitioner protested against the illegal activities carried on in the area.

Learned advocate for the State submits that the quantity of seizure is of commercial quantity. The police authorities have adhered to the provisions of law while conducting the raid, search and seizure. All efforts would be

taken by the Investigating Agency to expedite the process of trial.

Since the petitioner is in custody for almost a year and charges have already been framed, at this stage, I am reluctant to release the petitioner on bail. Petitioner would renew his prayer for bail after first 4 witnesses are examined by the prosecution.

Let the examination of 4 witnesses be completed by 30th April, 2026.

Petitioner would be at liberty to approach this Court after the evidence of such witnesses are over. At this stage, the bail application being CRM (NDPS) 1230 of 2025 is dismissed.

Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
