(Through Video Conference) Ms. Sumitra Das ... for the petitioner Ms. Deblina Lahliri ... for the Bank Initially, it was represented by the Bank that the appellate authority disposed of the appeal under the Right to Information Act, 2005. Today, it is submitted on behalf of the Bank that the order of the appellate authority is misplaced. Learned advocate for the Bank submits that the appellate authority will re-hear the appeal and pass a fresh order. Petitioner is represented.
In such circumstances, in my view, justice would be subserved by requiring the appellate authority to decide the appeal of the petitioner afresh. Needles to say, the appellate authority will afford a reasonable opportunity of hearing to the petitioner. The appellate authority is at liberty to hear such other parties and consult such documents as it deems necessary. He will pass a reasoned order and communicate the same to the petitioner within eight weeks from the date of communication of this order to him.
WPA 22043 of 2019 is disposed of without any order as costs.
