Sri Onkar Singh Meena Mr. Sayantan Hazra ...for the Applicant Mr. Sirsanya Bandopadhyay, ...for the alleged Contemnor Mr. Prabir Dasgupta, Mr. Suman Dey ...for University Mr. Sirsanya Bandopadhyay, learned advocate has made over a copy of a memorandum no. 111-F (Pen)/N/F/1P281/2023 dated February 6, 2024, issued by the Additional Chief Secretary, Finance Department, Govt. of West Bengal, whereby the State has extended the benefit of family pension to unmarried/widowed/divorced daughter beyond 25 years of age of the employees/pensioners of all State aided Universities.

It has been submitted by the learned advocate appearing for the applicant that her case has not yet been considered by the university.

The university authorities have not been impleaded as respondents in this contempt application. Therefore, I am not inclined to pass any order against the university on this contempt application. However, I make it clear that the

petitioner may make an application before the university to consider her case in the light of the aforesaid memorandaum dated February 6, 2024. Such application shall be considered and processed by the university in accordance with law.

In that view of the matter, I find no justification to proceed further against the alleged contemnor. Accordingly, CPAN 1396 of 2023 is disposed of. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with the requisite formalities.
