Learned advocate appearing for the petitioner submits that around 18 Kgs. of Ganja were recovered from the joint possession of the petitioner and another. Petitioners are in custody for 5 months and although charge sheet has been submitted and charge has been framed witness action has not started.

Learned advocate for the State opposes the prayer for bail.

Having considered the quantum of seizure in the present case, I am of the view that the provisions of Section 37 of the NDPS Act are not attracted.

Consequently, the petitioners shall be released on bail.

Petitioners, namely, Kohinoor Khatun and Mina Bibi shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Additional Sessions Judge cum Judge, Special Court, Hooghly.

If on bail, the petitioners shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the District of Hooghly without prior permission of the said Court.

Accordingly, CRM (NDPS) 1246 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
