1. Learned counsel for the petitioner argues that due to resistance by the private respondents, the electricity connection sought by the petitioner could not be given.

2. Affidavit-of-service filed in Court today be kept on record, which indicates proper service on all the respondents. Despite such service, the private respondents choose not to appear at the time of call.

3. Learned counsel appearing for the CESC Limited raises a minor technical objection regarding compliance of 'Annexure B' by the petitioner.

The petitioner, however, is agreeable to comply with such technical formality, as expressed in court through learned counsel for the petitioner.

4. Accordingly, WPA No. 23683 of 2023 is disposed of by directing the CESC limited to give electricity connection to the petitioner within two weeks subject to compliance of all formalities by the petitioner, including the formalities as raised by the CESC Limited.

5. In the event any obstruction is raised by the private respondents, it will be open to the CESC Limited personnel to approach the respondent no. 3, being the Officer-in-Charge, Rabindranagar Police Station, who will grant necessary assistance at the cost of the petitioner. It will also be open to the respondent no. 3 to break open the padlock and/or remove any hindrance, if necessary, to ensure that electricity connection is given to the petitioner.

6. There will be no order as to costs.

7. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities. (Sabyasachi Bhattacharyya, J.)
