Learned advocate for the petitioner submits that petitioner is in custody for 2 years 7 months. There was earlier direction to conclude the trial within a year from the date of communication of the order of the High Court and there was also direction to consider the bail application on merits in case the trial is not concluded within the aforesaid period.

Learned advocate for the State opposes the prayer for bail and submits that for a considerable period of time the Court was lying vacant and as such the trial could not proceed.

In course of the argument it has surfaced that on 20.02.2025 communication in respect of the direction passed for expeditious trial was made before the learned Special Court. Considering the same, I direct the State to exhaust the examination of the seizure list witnesses, namely, Debasish Roy and Prosenjit Agarwal by 20.02.2026.

In case the evidence of these two witnesses are not over, the learned Special Court would release the petitioner on bail on such condition as it deems fit and proper for ensuring his appearance in course of further trial of the case. 5.
With the aforesaid observations, CRM (NDPS) 1247 of 2025 is disposed of.
