Roy Ms. Sujata Das .... for the State The revisional application has been filed under Section 482 of Cr.P.C. on 3.10.2007 challenging the legality of a proceeding in G.R. Case No. 411 /2007 pending before the learned Judicial Magistrate, 3rd Court, Durgapur, Burdwan arising out of Durgapur P.S. Case No. 138 /2007 dated 02.06.2007 under Sections 323/324 of the Indian Penal Code, read with Section 14 of the Child Labour (Prohibition & Regulation) Act 1986. Mr. Ganguly, learned Advocate representing the petitioner by his argument tried to support the petition but upon perusal of records I find that after investigation police has submitted charge sheet.
Considering the nature of offence I am not inclined to invoke inherent jurisdiction to quash the proceeding. With the aforesaid observation, the criminal revision is disposed of without any order as to costs with the liberty to the petitioner to agitate all points before the learned trial Court in course of trial.
The copy of the order be sent down to the learned Trial Court for information and necessary action.
