Adil Badr Ms. Suruchi Saha ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner was allegedly implicated in connection with the instant case with 800 bottles of phensedyl and since then he is in custody for more than 10 months, as such, on any stringent condition, he may be enlarged on bail. Learned advocate for the State opposes the prayer for bail and submits that charge-sheet has been submitted; charges have already been framed and witness action would commence on and from the next date.

Having considered the period of detention of the present petitioner, I am inclined to enlarge the petitioner on bail.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Md. Salimuddin shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Judge, Special Court, Additional District Judge, 3rd Court, Malda. If on bail, the petitioner shall make himself physically available on each and every date of the trial so fixed by the learned trial court/Special Court and shall not leave the jurisdiction of Malda without prior permission of the Special Court.

Accordingly, CRM (NDPS) 1239 of 2025 is allowed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
