Kausik (Rejected) CRM (NDPS) 1256 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Madhyamgram Police Station Case No. 128/25 dated 23.02.2025 under section 20(b)(ii)(C) of the NDPS Act, 1985;

Learned advocate appearing for the petitioner submits that petitioner is in custody for about 10 months and there was recovery of 33 Kgs. of Ganja from 5 persons.

It has been further submitted that from the possession of the petitioner 5 Kgs. of Ganja were recovered and only one witness has been examined. As such there is no chance of the trial being concluded.

Petitioner as such prays for bail on any stringent condition.

Learned advocate for the State opposes the prayer for bail and submits that one witness has been examined and the

prosecution will put in endeavour to take the trial to its logical conclusion.

Having considered the quantum of seizure, I am not inclined to release the petitioner on bail.

As such CRM (NDPS) 1256 of 2025 is dismissed. Learned Trial Court is directed to expedite the process of trial and take the same to its logical conclusion within a reasonable period of time.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
