Petitioner(s) Mr. Joy Chakraborty Mr. Sandip Dinda ... for the Petitioner(s) Mr. Sobhan Gani ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner has been implicated on the accusations of recovery of 100 bottles of phensedyl and the petitioner is in custody for more than 11 months. Learned advocate again submits that although charges have been framed, but, till date, witness action has not commenced.

Learned advocate for the State opposes the prayer for bail and submits that there are antecedents of the present petitioner.

I have taken into account the period of detention of the present petitioner as also the stage of the case and, I am of the view that further detention of the present petitioner is unwarranted in the facts and circumstances of the case.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Abhijit Halder shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Additional Sessions Judge, 6th Court, Barasat, North 24 Parganas. If on bail, the petitioner shall make himself physically available on each and every date of the trial so fixed by the learned trial court and shall not leave the jurisdiction of North 24 Parganas without prior permission of the trial court.

Accordingly, CRM (NDPS) 1237 of 2025 is allowed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
