We have heard the learned advocate for the appellant and the learned advocate for the respondent/writ petitioner.

It has been pointed out by the learned advocate for the respondent/writ petitioner that the order and direction issued by the learned Single Bench dated 30th November, 2023 impugned in this appeal has been complied with inasmuch as a sum of Rs.7,52,750/- has been refunded to the writ petitioner by the appellant bank, what remains to be paid is simple interest payable at the rate of 10% per annum within a time frame fixed by the learned Single Bench.

In our considered view, the interest payable at the rate of 10% per annum appears to be on the higher side and since the bank has also refunded a sum of Rs.7,52,750/-, we modify the order and direction

issued by the learned Single Judge by reducing the rate of interest at the rate of 6% per annum, which shall be payable within a period of eight weeks from the date of receipt of the server copy of this order. The interest payable at the rate of 6% per annum shall be computed from 1st November, 2023 till the date of payment.

With the aforesaid direction, this appeal and the connected application are disposed of.
