Mr. Anirban Pal ... for the petitioner Ms. Ipsita Banerjee ... for the State Affidavit of service filed in Court is taken on record. Learned advocate for the petitioner submits as follows. The petitioner is the daughter of the respondent No.6 and the wife of the respondent No.7. After getting married to the respondent No.7, she was tortured at her matrimonial home. After sometime her father lodged a false complaint before the police alleging that his daughter was abducted. Sometime later her husband also came up with similar allegations. These are out and out false allegations. A complaint was made to the police, but no action was taken.
Learned advocate for the State submits that no formal application was made before the police that could be acted upon. A complaint sent by post by the petitioner does not make out any cognizable case.
It appears that the intimation to the police by the petitioner mainly deals with the two complaints allegedly lodged by the petitioner's father and husband. If the petitioner is aggrieved with any action of the private
respondents and it makes out a cognizable case, she shall be at liberty to take steps in terms of ratio laid down in Aleque Padamsee's case reported at (2007) 6 SCC 17. Therefore, no further order need be passed.
However, the police shall keep a sharp vigil at the locale and ensure that no breach of peace takes place. With these observations, the writ petition is disposed of.
