The present revisional application was preferred challenging the proceeding being Complaint Case No. 1238 of 2011 under Section 138 of the N.I. Act and pending before the Learned Chief Judicial Magistrate, Malda. The petitioner approached this Court at a stage when the Learned Magistrate was pleased to take cognizance of the offence and issued process against the accused person. Records of the revisional application reflects that till date the revisional application has not been admitted even after 9 years of filing of the same. None represented the petitioner to apprise this Court regarding the present stage of the proceeding before the Learned Magistrate. Further the point, which has been canvassed in the revisional
application are all question of facts, which has to be decided in course of the trial.
Having regard to the aforesaid, I am of the opinion that no interference is called for.
Accordingly, CRR 3237 of 2012 is dismissed.
Pending application, if any, is consequently disposed of.
