The petitioners are aggrieved by the inaction on the part of the Kolkata Municipal Corporation in taking steps for mutation of the Premises No. 172, Manicktolla Main Road.

The petitioners have annexed the mutation application receipt showing that the application in Form No. A-42 was submitted way back on 16th March, 2012.

It is submitted that till date the application for mutation has not been disposed of.

The petitioners in the present writ petition have not mentioned any reason explaining the delay in approaching this Court for relief. The present writ petition has been filed after more than ten years. It is quite probable that the Corporation will not be in a position to readily trace out such old document. Accordingly, leave is granted to the petitioners to file fresh application seeking mutation in the prescribed format along with the prescribed fees.

On receipt of the said application, the concerned authority of the Kolkata Municipal Corporation shall consider the same and intimate the petitioners the formality to be complied for effecting the mutation. If any further document is wanting, the same shall immediately be intimated to the petitioners.

Effort shall be taken to dispose of the application for mutation positively within a period of four months from the receipt of all documents from the petitioners. The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
